When it comes to raw political power, Republicans could replace the late Justice Ruth Bader Ginsburg before the election. Were President Trump and Majority Leader Mitch McConnell the no-holds-barred, win-at-all-costs knife fighters their reputations suggest, they would rush a nominee through before the election. With a 6-to-3 conservative majority on the Supreme Court, the Right could secure power over the levers of government for decades.

But power is not the only thing. Democratic legitimacy matters in America. We are in an election season, and it would be a sloppy rush job to run a whole confirmation process before Nov. 3 while one third of senators are out on the campaign trail. Trump shouldn’t rush anything, but he also shouldn’t shy away from the confirmation battle. There’s no precedent for a president declining to nominate someone to fill a Supreme Court vacancy simply because an election is coming.

Trump should nominate Ginsburg’s replacement. His nominee should be a conservative jurist — which is to say, a jurist who would stick to the letter of the law and the text of the Constitution, and not see him- or herself as a legislator or a culture warrior.

With a nominee before the Senate — not simply a name floated, but an actual nominee pending — the stakes of the 2020 election would be clear. You vote for Trump or a Republican senator if you want this person on the court. You vote for Democrats if you want the alternative.

And for that reason, Trump should demand that Joe Biden say whom he would nominate. We don’t want a long list of possible nominees, but a name.

Then the stakes of the 2020 Senate and presidential elections will be clear. Does the public want a judge who will make law or one who will interpret the law? Are Americans on board with the radical agenda of the left-wing groups, led by Planned Parenthood, that wish to use the courts to advance extremist policies that could never advance through democratic channels, or do they want restraint?

As an added bonus, putting up an actual nominee will flush out the Democrats in an election season.

The notion that Hillary Clinton would be nominating Supreme Court Justices is probably what cost her the election.   So yeah, let's see what Biden's got hiding up his sleeve...

Lessee, a Mueller investigation that went on for over 2 years and produced nothing, followed by the impeachment debacle and accusations that Trump's responsible for 190,000 Covid deaths.   Please explain why Trump and his supporters should give the Left consideration for anything.   Destroying statues and monuments, riots, looting and burning, your side doesn't give 2 sh**s about this country...

If the next nominee is nominated by Trump, they are going to be dragged through the tar pits by the Democrat inquisition team. Brett Kavanaugh's scandalous hearings will seem tame compared to what the next person will have to endure. It will take a strong stomach to watch.

A link is needed. The McConnell rule actually states “no confirmations in a presidential election year when opposite parties hold the senate and the presidency”. 

Anyway, McConnell is going to bring a candidate to a vote. In the meanwhile, did you see how gracious president Trump was when told about RBG’s passing?

I don't see a contradiction. Democrats may be citizens but they certainly aren't Americans. I would include some quotes from democrats trashing America but there are too many to choose from. A handful of quotes wouldn't do my point justice.

The author's suggestion is that the President nominate a candidate and then ask Biden to release a candidate of his own..  He also makes it clear that there isn't much chance of of confirmation before the election.

You had no problem with Obama nominating Garland (Although as soon as the Republicans bowed, he would have pulled Garland and put in a radical lefty reliever.) so if you do have a problem the current president doing it, you are arguing with yourself.

I don't really agree with the author but I don't object to the candidates release a list of potential nominees.  If you believe in *snort* your candidate, you shouldn't either.

Barack Obama 2016: "The Constitution is pretty clear about what is supposed to happen now. When there is a vacancy on the Supreme Court, the President of the United States is to nominate someone. The Senate is to consider that nomination and either they disapprove that nominee or that nominee is elevated to the Supreme Court. Historically this has not been viewed as a question."
